The four factors that move your number the most

  1. Severity and medical objectivity. Imaging and surgery move offers; subjective pain alone does not.
  2. Fault percentage. Comparative-fault states reduce recovery by your share of blame.
  3. At-fault policy limits. A $25,000 minimum-limits policy practically caps the case at $25,000 unless other coverage applies.
  4. Documented future care. Future surgeries, therapy, and lost earning capacity must be supported by treating physicians, not estimates.

What does not change your number much

  • How angry the at-fault driver was. Punitive damages are rare in routine MVA claims.
