The four elements
- Duty. Every driver owes other road users a duty to drive reasonably. This is almost always met in a crash claim.
- Breach. The other driver did something a reasonable driver would not have done, speeding, distracted driving, failure to yield, DUI.
- Causation. The breach caused your injury. This is where insurers most often push back if there is a gap in treatment or a prior condition.
- Damages. Measurable harm: medical bills, lost wages, pain and suffering, property damage.
Strong-case signals
- Police report attributing fault to the other driver.
- Photos or dashcam showing the mechanism of the crash.
- Same-day or next-day medical record.
- Witness statements taken at the scene.
- Objective injury findings on imaging.
- At-fault driver carrying meaningful liability limits.
Weak-case signals
- You were cited at the scene.
- Delayed treatment without explanation.
- Significant pre-existing condition in the same body part with no documented worsening.
- State minimum-limits policy with no UIM coverage on your side.
- State follows pure contributory negligence and you bear any share of fault.
