The five rules that decide value in New York

What drives New York wrongful death value

  • Decedent's earnings and life expectancy. The lost-support column is usually the largest damages category; economists calculate present value over remaining work life.
  • Dependents. Number and age of surviving children, spousal dependency, and parental dependency all move value.
  • Conduct severity. DUI, gross negligence, and intentional-harm facts open punitive damages and often exceed cap ceilings.
  • Insurance stack. Liability limits, umbrella policies, corporate/commercial coverage, and UM/UIM on the decedent's own policies.
  • Survival damages. A conscious pre-death interval — even minutes — creates a separately recoverable pain-and-suffering claim in most states.

What to do in the first 30 days after a New York wrongful death

  1. Open a probate estate and appoint the personal representative — many wrongful-death claims must be filed by the estate.
  2. Order certified death certificates (10+ copies) — required for every insurer, employer, and court filing.
  3. Get the police, medical examiner, and autopsy reports.
  4. Preserve the vehicle, product, or scene evidence before it is repaired or discarded.
  5. Do not sign a release, cash a settlement check, or negotiate with any insurer before counsel.
  6. Screen every possible defendant: driver, employer, product manufacturer, premises owner, government.
  7. File within 2 (updated by Grieving Families Act legislation, currently 3 years) years; government defendants carry much shorter notice deadlines.
